Pubdish strictly adheres to the Digital Millennium Copyright Act (DMCA)

Pubdish respects the intellectual property rights of others and expects our users to do the same. We comply with the provisions of the Digital Millennium Copyright Act (DMCA) and will respond expeditiously to claims of copyright infringement committed using our service.

Warning: By using Pubdish's distribution services, you acknowledge and agree that you own or have obtained all necessary rights, licenses, and permissions to distribute the content you submit. Any false claims or unauthorized distribution will be prosecuted to the fullest extent of the law.

Consequences of Infringement

Strict enforcement - No warnings, no second chances

Immediate Termination

Your distribution agreement will be terminated immediately upon verification of any copyright infringement. All content will be removed from all platforms within 24 hours.

Revenue Forfeiture

All outstanding revenue and royalties in your account will be forfeited. You will NOT be able to withdraw any funds. This is non-negotiable.

Permanent Ban

You will be permanently banned from Pubdish and will never be eligible to reapply or create a new account. Your name/company will be blacklisted.

Legal Action

Pubdish reserves the right to pursue legal action and seek damages. We will cooperate fully with copyright holders in any legal proceedings against infringers.

Important Notice

False copyright claims or attempting to upload content you don't own constitutes fraud. Pubdish will report fraudulent activity to relevant authorities and cooperate with law enforcement investigations. You may face criminal charges in addition to civil liability.

What Constitutes Copyright Infringement

Examples of prohibited content and activities

  • Unauthorized Covers:

    Distributing cover versions without proper mechanical licenses or permission from the original copyright holder.

  • Unlicensed Samples:

    Using samples from other artists' works without obtaining proper clearance and licensing.

  • Stolen Beats/Instrumentals:

    Using beats, instrumentals, or production from others without permission or proper licensing agreements.

  • Impersonation:

    Uploading content and falsely claiming to be another artist or rights holder.

  • Unauthorized Distribution:

    Distributing music that you don't own, didn't create, or don't have explicit written permission to distribute.

  • Stolen Artwork:

    Using album artwork, images, or graphics without permission from the creator or copyright holder.

  • Remix Without Authorization:

    Creating and distributing remixes without obtaining permission from the original artist and rights holders.

How to Report Copyright Infringement

If you believe your copyrighted work has been infringed

If you are a copyright owner or authorized to act on behalf of one, please submit a DMCA takedown notice to us with the following information:

Counter-Notification Process

If you believe your content was wrongly removed

Important: Due to our zero-tolerance policy, counter-notifications are rarely successful. However, if you believe content was removed in error due to misidentification or mistake of fact, you may submit a counter-notification.

To file a counter-notification, you must provide:

  • Your physical or electronic signature
  • Identification of the material that was removed and its location before removal
  • A statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  • Your name, address, and telephone number
  • Consent to jurisdiction of the federal court and acceptance of service of process

Critical Warning

Filing a false counter-notification constitutes perjury and may result in criminal prosecution. Even if your counter-notification is accepted, your account termination and revenue forfeiture remain in effect. We reserve the right to deny any counter-notification at our sole discretion.

Repeat Infringer Policy

One violation = Repeat infringer status

Pubdish maintains a strict policy for terminating accounts of users who are repeat copyright infringers. Under our one-strike policy, a single verified infringement makes you a "repeat infringer."

This means:

  • Immediate permanent ban from Pubdish platform
  • Your information shared with other distributors and industry databases
  • Difficulty distributing music through other legitimate services
  • All pending and future royalties forfeited permanently
  • Potential legal liability to both Pubdish and copyright holders

We take copyright protection seriously. Protect your career - only distribute content you own or have permission to use.

Your Responsibilities

What you must ensure before distributing content

Before submitting any content to Pubdish for distribution, you are responsible for ensuring:

Copyright Ownership

You own all rights to the master recording or have obtained written permission from all rights holders.

Publishing Rights

You have obtained mechanical licenses for any cover songs or compositions you didn't write.

Sample Clearances

All samples used in your music are properly licensed or you own the original recordings.

Artwork Rights

You own or have permission to use all artwork, images, and visual content associated with your release.

Featured Artists

You have written agreements with all featured artists, producers, and contributors.

Label Agreements

If applicable, you are not violating any existing distribution or record label agreements.

By submitting content, you certify under penalty of perjury that all of the above are true.
