At Pubdish, we believe that disputes should be resolved fairly, efficiently, and with minimal disruption to your music career. This Dispute Resolution Policy outlines the process for addressing conflicts that may arise between artists, labels, and Pubdish.
Our goal is to resolve issues through open communication and mediation whenever possible, reserving formal arbitration for cases that cannot be settled through other means.
Disagreements about payment amounts, timing, or distribution calculations.
Conflicts over content ownership, copyright claims, or distribution rights.
Interpretation or enforcement of Distribution Agreement terms.
Disputes regarding account suspensions, terminations, or policy violations.
Disagreements between artists and labels using our platform.
Issues with platform functionality, content delivery, or service quality.
Most disputes can be resolved through open, honest communication. We encourage parties to attempt direct resolution first.
Contact the other party: Clearly explain your concern and desired resolution.
Document everything: Keep records of all communications and evidence.
Set a timeline: Allow 7-14 days for the other party to respond.
Stay professional: Maintain respectful communication throughout.
Success Rate: Approximately 60% of disputes are resolved at this stage.
If direct communication fails, request mediation through Pubdish. Our team will facilitate a fair resolution.
Submit a formal request: Email [email protected] with "Dispute Mediation Request" in the subject line.
Provide documentation: Include all relevant evidence, communications, and contract terms.
Initial review: Pubdish reviews the case within 5 business days.
Mediation session: Both parties participate in a facilitated discussion (video call or email).
Proposed solution: Pubdish proposes a fair resolution based on facts and policies.
Timeline: 14-21 days average
Cost: Free for all users
If mediation fails, disputes proceed to binding arbitration. This is a final, legally enforceable resolution process.
Neutral arbitrator: An independent third-party arbitrator is selected mutually or appointed.
Evidence submission: Both parties present evidence, documents, and arguments.
Hearing process: Formal or informal hearing conducted via video conference or in writing.
Final decision: Arbitrator issues a binding decision enforceable in court.
No appeals: The arbitrator's decision is final with very limited appeal rights.
Timeline: 30-90 days
Cost: Shared by both parties
Arbitration waives your right to a jury trial or class action lawsuit.
Arbitration shall be conducted under the rules of a recognized arbitration organization, such as:
Arbitration proceedings shall be conducted in English and held in a mutually agreed location or virtually via video conference. For disputes involving Pubdish, the default venue is where Pubdish's principal office is located, unless otherwise agreed.
Both parties will attempt to mutually select an arbitrator within 14 days. If no agreement is reached:

IMPORTANT: By agreeing to arbitration, you waive your right to participate in class action lawsuits or class-wide arbitration proceedings. All disputes must be brought individually.
The following disputes are NOT subject to arbitration and may be brought in court:
Copyright infringement, trademark disputes, and DMCA violations may be litigated in court due to urgency and need for injunctive relief.
Cases requiring immediate court orders to prevent irreparable harm (e.g., unauthorized content distribution, account hijacking).
Disputes under your local small claims court monetary limit may be filed in small claims court instead of arbitration if both parties agree.
Claims that cannot legally be arbitrated under applicable law (varies by jurisdiction).
Review all contracts and terms before signing. Ask questions if anything is unclear.
Address concerns early before they escalate into formal disputes.
