This Distribution Agreement ("Agreement") is entered into between Pubdish ("Distributor," "we," "us") and the invited artist or record label ("Partner," "you," "your") for the purpose of distributing musical recordings to digital streaming platforms and download stores worldwide.
Important Notice
Pubdish operates as an invite-only, selective distribution platform. This agreement is only extended to artists and labels who have been personally invited and have successfully completed our application process. Each partnership is individually negotiated based on your catalog, reputation, and distribution needs.
You grant Pubdish the non-exclusive right to:

Worldwide distribution across 195 countries and all available digital platforms.
Initial Term
The initial term is specified in your individual agreement (typically 1-3 years) and automatically renews unless terminated with written notice.
Termination Notice
Either party may terminate with 30 days written notice. Upon termination, Pubdish will initiate takedown of your catalog within 2-4 weeks, though some platforms may take additional time to complete removal.
You keep 100% of your streaming royalties
Pubdish provides completely free music distribution with no revenue share, no commissions, and no hidden fees.
You represent and warrant that:
You agree to indemnify and hold Pubdish harmless from any claims, damages, or expenses (including legal fees) arising from copyright infringement, breach of warranties, or violation of third-party rights related to your submitted content. Pubdish maintains a strict one-strike copyright policy - any confirmed infringement results in immediate termination and forfeiture of unpaid royalties.
Pubdish registers your recordings with Content ID systems (YouTube, Facebook, etc.) to protect your copyrights and collect monetization revenue from user-generated content.
Pubdish's liability is limited to the amount of royalties earned by your catalog in the 12 months preceding any claim. We are not liable for platform delays, technical issues, or changes in streaming platform policies beyond our control. While we strive for 99.9% uptime, we cannot guarantee uninterrupted service or specific streaming/sales results.

Agreement Term

Termination by Partner
You may terminate this Agreement with 30-90 days written notice (as specified in your contract). Upon termination, content takedown from platforms occurs within 2-4 weeks.
Termination by Pubdish
Pubdish may terminate immediately for breach of agreement, copyright infringement, fraudulent activity, or violation of our policies.
Post-Termination
You will receive all earned royalties up to the termination date (subject to platform reporting delays). Pubdish retains no rights to your content after takedown completion.
Revenue split depends on your account type:
Note: All percentages are calculated from net revenues after platform fees. Platform fees (Spotify, Apple Music, etc.) are industry-standard and deducted before distribution to Pubdish.
Partner represents and warrants that:
Partner agrees to indemnify and hold Pubdish harmless from any claims, damages, losses, or expenses arising from: (a) breach of this Agreement, (b) infringement of third-party rights, (c) false representations or warranties, or (d) violation of any laws or regulations.
Pubdish's liability is limited to the amounts actually paid to Partner in the 12 months preceding the claim. We are not liable for:
Governing Law: This Agreement is governed by the laws specified in your individual contract (commonly the jurisdiction where Pubdish is registered).
Mediation: Parties agree to attempt good faith mediation before initiating legal proceedings.
Arbitration: If mediation fails, disputes will be resolved through binding arbitration as specified in your individual agreement.
Both parties agree to keep confidential all non-public information disclosed during the term of this Agreement, including but not limited to: revenue figures, royalty rates, business strategies, and proprietary technologies. This obligation survives termination of the Agreement.
